Impaired driving defence in Victoria

British Columbia’s impaired driving laws are among the most complicated in Canada. Many drivers face two processes at once: a Criminal Code charge in court and a driving prohibition from the province. We help with both impaired driving charges and driving prohibitions.

A breath reading over the limit, or “blowing over”, does not automatically mean a conviction. The Crown must prove its case beyond a reasonable doubt, and we look carefully at how the police investigation and the breath testing were carried out. Even where the evidence appears strong, a DUI lawyer may still be able to reduce the impact of the case on your licence, your job and your record.

Contact us quickly. Roadside prohibitions have a 7-day deadline to apply for a review, and the 3-, 7-, 30- and 90-day suspensions take effect right away. We also advise on vehicle impoundment and on charges of driving while prohibited.

Charged with impaired driving in Victoria? Key facts

From British Columbia DUI Lawyers: most impaired driving stops in BC begin with an Immediate Roadside Prohibition (IRP) under the Motor Vehicle Act, and police can also lay Criminal Code charges. A FAIL reading or a refusal brings a 90-day driving prohibition, a 30-day vehicle impoundment, a $500 administrative penalty and a $250 licence reinstatement fee, and RoadSafetyBC may require the Responsible Driver Program or the Ignition Interlock Program. You have only 7 days to apply for a review, so speak with a lawyer right away. If you are also charged under the Criminal Code with impaired driving, over 80 or refusal, that court case runs separately from the IRP, and a conviction can bring a fine, a driving prohibition and a criminal record.
