Impaired driving defence in BC

British Columbia has some of the toughest impaired driving laws in the country. A driver can face Criminal Code charges for impaired driving or driving over .08, and an Immediate Roadside Prohibition under the Motor Vehicle Act at the same time. We defend both. We challenge whether the Crown can prove its case, including the reliability of breath testing devices and errors in police procedure, and we represent clients at hearings to dispute roadside driving bans.

When an IRP review does not succeed, we can ask the BC Supreme Court to review the decision. We also act on Superintendent prohibitions and dangerous driving charges. Our goal is to help you keep your driving privileges and your record.

Charged with impaired driving in Vancouver? Key facts

From British Columbia DUI Lawyers: most impaired driving stops in BC begin with an Immediate Roadside Prohibition (IRP) under the Motor Vehicle Act, and police can also lay Criminal Code charges. A FAIL reading or a refusal brings a 90-day driving prohibition, a 30-day vehicle impoundment, a $500 administrative penalty and a $250 licence reinstatement fee, and RoadSafetyBC may require the Responsible Driver Program or the Ignition Interlock Program. You have only 7 days to apply for a review, so speak with a lawyer right away. If you are also charged under the Criminal Code with impaired driving, over 80 or refusal, that court case runs separately from the IRP, and a conviction can bring a fine, a driving prohibition and a criminal record.
