I am Aman Jaswal, a criminal defence lawyer serving Victoria, British Columbia. I have defended hundreds of criminal cases, and impaired driving defence is a core part of my practice. If you have been charged with a DUI in Victoria or elsewhere on Vancouver Island, get advice before you decide how to plead.
I regularly handle impaired driving, over 80 and refusal charges, as well as roadside driving prohibitions. A drinking and driving allegation in BC usually sets off two separate processes: a criminal case in court and an administrative licence sanction from the province. I help clients understand both, so that a decision in one does not hurt them in the other.
Being charged is not the same as being convicted. Before you make any decision about a plea or a court appearance, I review every stage of the police investigation: the reason for the stop, the roadside testing, the breath or drug demands, and whether the officers followed the required procedures. Where the prohibition or the charge was not properly made, I challenge it.
Roadside prohibitions carry short deadlines, including 7 days to apply for a review of an IRP, so it is important to call early.
I serve clients in Victoria, Saanich, Esquimalt, View Royal, Langford and across the Capital Region.
From British Columbia DUI Lawyers: most impaired driving stops in BC begin with an Immediate Roadside Prohibition (IRP) under the Motor Vehicle Act, and police can also lay Criminal Code charges. A FAIL reading or a refusal brings a 90-day driving prohibition, a 30-day vehicle impoundment, a $500 administrative penalty and a $250 licence reinstatement fee, and RoadSafetyBC may require the Responsible Driver Program or the Ignition Interlock Program. You have only 7 days to apply for a review, so speak with a lawyer right away. If you are also charged under the Criminal Code with impaired driving, over 80 or refusal, that court case runs separately from the IRP, and a conviction can bring a fine, a driving prohibition and a criminal record.
