Description

I am Jonathan J. Israels, a Vancouver criminal defence lawyer and a former Crown prosecutor. I now act only for the defence, and I bring my experience from the other side of the courtroom to every impaired driving case I take on.

Impaired driving defence in Vancouver

Impaired driving charges are extremely technical. They include drunk driving, driving with a blood alcohol level over .08, and refusing to provide a breath sample. Police officers and breath technicians must obey strict rules and procedures, and when they do not, there are many defences available to challenge the evidence. Those challenges can often lead to the breath certificate being excluded, which can decide the whole case.

Because I have prosecuted cases, I understand how Crown counsel assesses impaired driving files, what evidence they rely on, and where a case is likely to be weak. I review the reasons for the traffic stop, the timing of the breath demands, your right to counsel, and every step of the breath testing process before I advise you on how to plead.

I also help clients facing Immediate Roadside Prohibitions and other driving matters, as well as assault, sexual assault, drug and property charges.

Charged with impaired driving in Vancouver? Key facts

From British Columbia DUI Lawyers: most impaired driving stops in BC begin with an Immediate Roadside Prohibition (IRP) under the Motor Vehicle Act, and police can also lay Criminal Code charges. A FAIL reading or a refusal brings a 90-day driving prohibition, a 30-day vehicle impoundment, a $500 administrative penalty and a $250 licence reinstatement fee, and RoadSafetyBC may require the Responsible Driver Program or the Ignition Interlock Program. You have only 7 days to apply for a review, so speak with a lawyer right away. If you are also charged under the Criminal Code with impaired driving, over 80 or refusal, that court case runs separately from the IRP, and a conviction can bring a fine, a driving prohibition and a criminal record.
