Description

We are Filkow Law, a BC criminal defence firm led by Kevin A. Filkow, and we are a leading authority on criminal drinking and driving law. Our lawyers help drivers across the Lower Mainland, the Fraser Valley and the Okanagan with Immediate Roadside Prohibitions, impaired driving charges and driving prohibitions.

How we approach an IRP

An IRP is not a criminal case and it is not a simple traffic ticket. It is an administrative sanction under the Motor Vehicle Act, with its own rules and a strict seven-day deadline to apply for a review. We examine the officer’s Report to Superintendent line by line, and we look closely at the calibration and maintenance of the approved screening device, where errors can decide the case. We handle Warn and Fail prohibitions, refusals and Administrative Driving Prohibitions, and if a review does not succeed, we can take the case further by judicial review in the Supreme Court of British Columbia.

We also defend Criminal Code impaired driving and over 80 charges, driving while prohibited, and the ICBC insurance breaches that can follow a driving offence.

Charged with impaired driving in the Lower Mainland? Key facts

From British Columbia DUI Lawyers: most impaired driving stops in BC begin with an Immediate Roadside Prohibition (IRP) under the Motor Vehicle Act, and police can also lay Criminal Code charges. A FAIL reading or a refusal brings a 90-day driving prohibition, a 30-day vehicle impoundment, a $500 administrative penalty and a $250 licence reinstatement fee, and RoadSafetyBC may require the Responsible Driver Program or the Ignition Interlock Program. You have only 7 days to apply for a review, so speak with a lawyer right away. If you are also charged under the Criminal Code with impaired driving, over 80 or refusal, that court case runs separately from the IRP, and a conviction can bring a fine, a driving prohibition and a criminal record.
